Florida is stricter than most states on this point. Under Chapter 440 of the Florida Statutes, a construction business needs workers' compensation coverage from its first employee. Non-construction employers get to four employees before the requirement bites. There is no grace period and no small-crew exemption, and officers can only exempt themselves within tight limits.
The part that costs Southwest Florida contractors the most money is subcontractor liability. If you hire a sub who does not carry his own coverage, his injured worker becomes your claim and his payroll gets added to your audit. Collecting certificates before the work starts is not paperwork — it is the difference between a clean audit and a five-figure surprise.
